OFFICIAL REGULATION OF THE PROMOTIONAL CAMPAIGN
"Black Friday cu masina"

I. The Organizer and the legal framework

              The promotional campaign "Black Friday cu masina" (hereinafter referred to as the "Campaign" or "Giveaway") is organized by Qwerty Key S.R.L., with its registered office in Romania, Maramureș, Baia Mare, Strada Oituz, Nr. 3A, Postal Code 430202, registered with the Trade Register under no. J2021000964244, CUI: RO44393084, hereinafter referred to as the "Organizer".
              This Regulation is drafted and made public in accordance with the applicable Romanian legislation, including, without limitation: Government Ordinance no. 99/2000 regarding the marketing of products and services on the market (with subsequent amendments and completions), Law no. 506/2004, Regulation (EU) 2016/679 (GDPR) and the relevant implementing rules. The Organizer's Clients will learn about the Campaign on the website www.qwertykey.ro, from social media pages, from the Organizer's employees, or from other communication channels. By registering for the Campaign, the participant declares that they have read, understood, and fully accept this Regulation.

              

II. Location, Duration, and Mechanism of the Campaign:

                Campaign Period: The Campaign runs for a single day, on November 7, 2025 between 00:00 and 24:00, and involves the automatic inclusion of all customers who placed an order for products on the website www.qwertykey.ro during the campaign period and who, by the drawing date, namely December 10, 2025, have paid the order in full and have not returned the products from the order to the Organizer. Orders placed outside this period will not be taken into account.

                Scope of the Campaign: The Campaign takes place within the territory of Romania, exclusively online, on the website www.qwertykey.ro and official social media channels.

                Participating products: all products listed for sale on the website www.qwertykey.ro, during the Campaign Period (November 7, 2025).

 

III. Right to Participate (Eligibility)

                 The Campaign is accessible to all individuals who have reached the age of 18, regardless of nationality, domicile, race, sex, gender, or religion, residing in Romania, who respect and fulfill the conditions of these Terms and Conditions. Employees of the Organizer, as well as their first and second degree relatives, cannot participate in the Campaign.

                The right to participate belongs exclusively to the customer who meets the conditions set forth in the Terms and Conditions. The right to participate in the Campaign is automatically canceled and the customer is disqualified if the person does not meet any of the conditions provided in these Terms and Conditions (including, but not limited to, the case where they return the ordered products by the drawing date of December 10, 2025) or if they provide false, incorrect, or inappropriate information when completing their personal data. Participants are responsible for the accuracy of the data provided to the Organizer, and this data will be used both for processing the order and for informing participants about the prizes won, and will be necessary for validating the winner and awarding the prize. By placing orders that meet the conditions for participation in the Campaign, customers expressly agree to the publication and public disclosure of their name in the event they are declared prize winners. 

          By participating in the Campaign, the customer freely and fully accepts the provisions of these Terms and Conditions.

 

IV. How to participate (Campaign Mechanism)

                 To participate in the "Black Friday with a car" campaign, you need 4 simple steps:

1)      Place an order on www.qwertykey.ro on November 7, Black Friday, between 00:00 and 24:00;

2)      Pay for the order online or to the courier upon receipt;

3)      Pick up/receive the delivered package;

4)      DO NOT return the ordered products.

                 Each eligible order constitutes 1 chance in the lottery. If you place multiple orders, you receive one chance for each eligible order. Returning products according to GEO 34/2014 leads to cancellation of participation related to the returned order.

V. Prize, awarding and winner announcement

                  The prize consists of a BMW E90 brand car, year of manufacture 2010, 85kw, 1995 cm3, customized with the Qwertykey logo. The commercial value of the prize is 19,315 RON (3,800 EURO at the NBR exchange rate on 10/30/2025).

           

             The winner of the prize offered in this promotional lottery, the promotional campaign "Black Friday with a car"  does not have the possibility to receive the cash equivalent of the prize, exchange it for other goods, or transfer the right to claim it to another person.

    

VI. Designation, contact and validation of the winner

                    The winner will be selected by draw on December 10, 2025, using a random mechanism. After the draw, Qwerty Key representatives will identify the winning customer's name by referencing the order drawn and will publish it (name, surname and order number) on the website www.qwertykey.ro and on the official Instagram account @qwertykey.ro. By participating in the raffle, participants agree that, if they win the prize in the Campaign, their identity and awarded winnings will be made public and used for promotional purposes, without any further obligations or payments from the Organizer

                    The draw will be conducted transparently, in the presence of an internal committee. An award report will be drawn up. The winner will be contacted by email and phone within 5 working days of the draw.

                     For validation, the Organizer may request: proof of order (invoice/receipt/confirmation), identification data necessary for delivery and fulfillment of tax obligations. To receive the prize, the winner must confirm that they accept the prize and send the Organizer a copy of their identity card. If the winner does not send the information requested by the Organizer for the prize handover within 5 days, or if they have provided incomplete, incorrect, or false data, or if it is proven that they do not meet the Campaign conditions, the prize will be awarded to another participant through a new draw

                      The prize handover will be carried out as follows:

• the car will be collected by the winner during the period December 11, 2025 - December 19, 2025 from the following address: Str. Oituz, no. 3A, Baia Mare, Maramures County, after signing the documents and completing the necessary formalities for the transfer and registration of the car's ownership in the winner's name with the competent authorities (including registering the car with the competent Local Taxes and Fees Directorate in the winner's name). If the winner cannot appear in person, they may authorize another person to collect the car through a special power of attorney in notarized form. The person who actually collects the car must hold a valid driver's license.

         In case a winner refuses to benefit from the prize, or fails to collect the prize within the term

indicated or in case the winner cannot be validated according to these Regulations, the winner will lose the right to be awarded the prize, and the Organizer will organize another draw

 

VII. Tax section

                      The Organizer will calculate and transfer, in accordance with the provisions of Title IV, Chapter VIII, of Law no. 227/2015 regarding the Fiscal Code, with subsequent amendments and additions, the tax related to the prize income, to the extent that the awarded prize exceeds the legally established taxable threshold (600 lei, value including VAT).

                        The Organizer is obliged to pay the tax due according to Title IV, Chapter VIII, of Law no. 227/2015 regarding the Fiscal Code, and will record it as a non-deductible expense of the company.

                      The tax is final and is withheld at source by the Organizer, who declares and pays it by the 25th of the following month.

 

[Calculation example: Prize value = 19,315 lei → Net income = 19,315 – 600 = 18,715 lei; Withheld tax = 10% × 18,715 = 1,871.50 lei (rounded according to applicable tax rules: 1,872.00 lei)].

                    Taxes withheld at source related to the prizes will be fully covered by the Organizer.

              The winner of the car, as the new owner, will pay any applicable fees related to transferring the ownership of the car to their name with the competent authorities (D.R.P.C.I.V., the competent Local Taxes and Fees Directorate, RCA, etc.).

VIII. Personal data protection (GDPR)

                  In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR) QWERTY KEY SRL, with the identification data above), as the operator, will process the personal data of the lottery participants in compliance with legal provisions and in accordance with the provisions below. By participating in the lottery, participants express their consent for QWERTY KEY SRL to process the personal data provided to the Organizer.

                  Categories of data - The personal data processed by the Organizer are the data provided directly by participants regarding first and last name, delivery address, email address and phone number, and in the case of winners, any additional personal data required by law for the transfer of ownership rights over the prize (e.g., Identity Card, Personal Numeric Code, signature, etc.).

                   This data is necessary for participation in the lottery, awarding of prizes, and compliance with tax-accounting legislation.

                   Personal data will be processed for the following purposes: conducting the Campaign, awarding the prize, public announcement of the winner, handling requests and complaints, transfer of ownership rights over the prize, fulfillment of legal and accounting obligations, marketing.

                   For these purposes, the processing of personal data is based on the following grounds:

• the consent of the participants expressed by participating in the Campaign (the promotional lottery);
• legal obligations that the Organizer has under commercial, tax-accounting, record-keeping legislation, etc.;
• the legitimate interests of the Organizer consisting in the development of its activity, analyzing and tracking the sales operations of its products, and marketing related to the company's activity.

                   Personal data will be stored for the duration of the Campaign and the awarding of prizes, as well as subsequently for determined periods according to applicable tax and archiving legislation.

                   The data may be disclosed to:

• the employees of the Organizer;
• the contractual partners of the Organizer who provide services to the Organizer for the conduct of the activity and the Campaign, including, among others, promotion and marketing services, tax and accounting services, IT system maintenance services, legal services, courier services, etc.;
• public authorities in case of requests made within the scope of these authorities' competencies or a legal requirement to that effect (including but not limited to R.P.C.I.V., the competent Local Taxes and Duties Directorate, etc.);
• other entities that can ensure the protection of the Organizer's rights (e.g., lawyers, notaries, translators, etc.);
• the general public, regarding the first and last names of the winners.

                      The personal data of raffle participants will not be transferred outside the E.U.

Failure by clients to provide personal data will result in the inability to participate in the Campaign.

                      Each raffle participant is informed that they have the right to request the Organizer, in accordance with applicable legislation, regarding their personal data, to access, rectify, or erase it, or to restrict its processing, the right to object to processing, as well as the right to data portability and not to be subject to an automated individual decision.

                To exercise these rights, the client may submit a written, dated, and signed request to the Organizer at the following email address: contact@qwertykey.ro.

                  Additionally, the participant has the right to file a complaint with the National Supervisory Authority for Personal Data Processing in Romania if they believe that their rights regarding the processing of personal data have not been respected.

                 Participants may withdraw their consent for the processing of their personal data for any of the purposes mentioned above at any time and free of charge, without, however, affecting the lawfulness of the processing activities carried out prior to the withdrawal. In the case of withdrawal of consent for the processing of data provided for registration in the campaign, the participant status ceases from the moment of withdrawal. In accordance with the applicable legislation in the field of personal data processing, the client has the following rights: the right to be informed, the right of access to data, the right to rectification, the right to erasure of data ("the right to be forgotten"), the right to restriction of processing, the right to data portability, the right to object, as well as the right not to be subject to an automated individual decision, including profiling, which could produce legal effects concerning the client or similarly affect them to a significant extent. To exercise these rights, any person may submit a written, dated, and signed request to QWERTY KEY SRL, Baia Mare, Jud. Maramures, Str. Oituz, nr. 3a or to the email address: contact@qwertykey.ro .

 

 

 

IX. Publicity and Amendment of the Rules

                 The rules are available free of charge at www.qwertykey.ro and at the Organizer's headquarters, throughout the entire Campaign. The Organizer reserves the right to modify/supplement the Rules by publishing an additional document on the website at least 24 hours before it comes into effect.

X. Liability. Fraud. Force Majeure

ORGANIZER'S LIABILITY

                  The Organizer is not responsible for technical errors, connection interruptions, website malfunctions, courier delays, or other situations beyond its control. Any attempt at fraud will result in the invalidation of participation.

                  The Organizer will not be liable for any damages suffered by the winner, regardless of the nature of these damages, from the moment the prize is handed over to the winner, and in connection with the winner's use of the prize.

                   In case of force majeure (earthquakes, pandemics, wars, government decisions, etc.), the Organizer is exempt from liability for the duration of the event.

                   The winner's inability to take possession of the prize in this Campaign exempts the Organizer from any liability.

 

WINNER'S RESPONSIBILITY

                   Any obligations of the winner related to the use of the prize are solely the winner's responsibility from the moment of receipt. The winner of the automobile will have the obligation to sign all necessary documents for the handover and transfer of ownership of the automobile to the winner, and to sign documents and complete the necessary formalities for registering the ownership of the automobile in the winner's name with the competent authorities, as well as to comply with all obligations as the owner of an automobile (e.g., obtaining a mandatory third-party liability insurance policy, etc.).

                By accepting the raffle entry and claiming the prize, the winner expresses their agreement to participate in all promotional activities organized by the Organizer related to this Campaign.

 

XI. Applicable legislation and complaints

                    The Campaign is organized in accordance with Romanian legislation, including GEO no. 34/2014, Law no. 363/2007, and GDPR.

                     Complaints regarding the organization of the Campaign can be sent by e‑mail to contact@qwertykey.ro în within a maximum of 5 working days from the date of the winner's designation.

                     In case of disputes arising between the Organizer and the Campaign participants, they will be resolved amicably. If it is not possible to resolve the disputes amicably, the parties involved in the dispute will submit the dispute for resolution to the competent Romanian courts within the territorial jurisdiction of the Organizer's headquarters.

                     

XII. Final provisions

                    By participating in the Campaign, participants declare that they have read, understood, and fully accept these Regulations. In case of discrepancies between promotional materials and the Regulations, the Regulations shall prevail.

                   This Campaign is a promotional lottery conducted by the Organizer in accordance with the provisions of Government Ordinance no. 99/2000, regarding the marketing of products and services on the market, republished, with subsequent amendments and additions, and has an advertising purpose, aiming to promote the Organizer's products, stimulate sales during the Black Friday Campaign, and retain customers.             

              The provisions of these Regulations are supplemented by the applicable legislation in force and by the terms and conditions of the prize suppliers.
